Elsa Kaiser was stopped by Charnetta Simmons as Kaiser left the medical center where her obstetrician worked.  Kaiser was in her final month of pregnancy, and Simmons offered her $25 to complete a survey about pregnancy and back pain.  Simmons convinced Kasier to enter Simmons’ vehicle, where Simmons stabbed Kaiser in the chest and then struck her repeatedly in the head.  Kaiser was incapacitated but not killed.  Simmons drove around with Kaiser in her car for some time while Kaiser (who thought she may have gone into labor) begged to be taken to an ER.

It was late in the evening when Simmons drove to a medical center and Kaiser managed to break out of the car and drag herself to another vehicle with people in it.  This brought the parking lot security and Kaiser eventually was taken to the ER while the police were contacted.     Simmons was placed in a psychiatric 72-hour hold after her arrest, where she was interviewed by a psychiatrist.  The psychiatrist noted that Simmons denied auditory hallucinations and did not have any gross memory disturbances.   However, Simmons’ defense team included a psychiatrist who reported that Simmons did have auditory hallucinations that insulted her, and diagnosed her with Major Depression with Psychotic Features.    The court agreed that Simmons had a mental illness but concluded that it did not reach the severity to meet the criteria of legal insanity (she knew what she was doing and that it was wrong).
